RE/MAX "10", (hereafter "Broker") and Robert Sher - Leasing Agent (hereinafter "Agent")
Term of Agreement. Unless otherwise agreed by Landlord and Broker in writing, this Agreement shall last until 11:59pm on December 31, 2018.
Services. In an effort to procure such renter(s), Broker shall advertise each listing; and full rights to all marketing photography is licensed to Agent. Advertisements may include, but will not be limited to, internet advertising, newspaper advertising, distribution of postcards, and/or other means of advertising non-exclusive rental listings. Broker will make all necessary arrangements to schedule showings of the unit(s) for prospective Renter and Landlord. We will provide Landlord with the Renter's profile, and Landlord will make the ultimate determination regarding the applicant's suitability and credit worthiness. Landlord allows Broker to post a FOR RENT sign on landlord's property.
Compensation. No compensation is due to the Broker and if landlord accepts renter provided by Broker, landlord has option to give renter the first month free. Broker will seek to be compensated by the Renter.
Authorizations and Representations. Each party hereto warrants and represents that it is fully authorized to enter into this Agreement and to carry out the obligations provided herein. Landlord warrants and represents that they are the owner of record and/or authorized agent of the owner of record of the units described on page 1 of this Agreement. Broker and Landlord agree to be bound by the terms and conditions of this Agreement.
Liability. Landlord agrees to indemnify and hold Agent and Broker harmless against any claims, causes of actions, suits, and/or threats of legal action. Landlord acknowledges that any building code violations at the Property must be made known to any Prospective Renters in writing prior to the execution of a lease agreement. Notwithstanding anything to the contrary in this agreement, Agent and Broker shall not be liable for any special, indirect, consequential, lost profits, or punitive damages sustained or incurred in connection with this agreement, and whether or not such damages are foreseeable.
Entire Agreement. This Agreement contains the entire agreement of Landlord and Broker with respect to the subject matter hereof. There are no agreements, understandings, assurances, promises, warranties, covenants, or undertakings with respect to the subject matter of this Agreement that are not set forth in this Agreement. This Agreement supersedes all prior or contemporaneous agreements, discussions or representations, whether oral or written, with respect to the subject matter hereof.
Fair Housing Act. IT IS ILLEGAL FOR EITHER THE OWNER OR THE SPONSORING BROKER TO REFUSE TO DISPLAY, LIST, LEASE OR SELL, OR REFUSE TO NEGOTIATE FOR THE LEASE OR SALE OF, OR OTHERWISE MAKE UNAVAILABLE OR DENY REAL ESTATE TO ANY PERSON BECAUSE OF ONES MEMBERSHIP IN A PROTECTED CLASS, (E.G., RACE, COLOR, RELIGION, NATIONAL ORIGIN, SEX, ANCESTRY, AGE, MARITAL STATUS, PHYSICAL OR MENTAL HANDICAP, FAMILIAL STATUS, OR ANY OTHER CLASS PROTECTED BY ARTICLE 3 OF THE ILLINOIS HUMAN RIGHTS ACT). OWNER AND SPONSORING BROKER ACKNOWLEDGE THAT THEY SHALL ALSO BE BOUND BY THE PROVISIONS OF STATE AND LOCAL (CITY AND/OR COUNTY) HUMAN RIGHTS OR FAIR HOUSING ORDINANCES, IF ANY, AND AGREE TO COMPLY WITH SAME.
